Football Banning Orders in Criminal
Proceedings
Football Spectators Act 1989
(FSA),
section 14A:
- The section applies where
an offender is convicted of a
relevant offence.
- If the court (Magistrates'
Court or Crown Court) is satisfied that there are reasonable
grounds to believe that making a banning order would help
prevent violence or disorder at or in connection with any
regulated football matches it must make such an order in
respect of the offender.
- If the court is not so
satisfied it must state that fact and give reasons in open
court.
- A banning order under this
section can only be made as an ancillary order on sentence.
This includes an absolute or conditional discharge.
